China’s Claim that Taiwan Strait is not International Waters Raises Concerns

According to reports from June 12th, in recent months, the Chinese Communist Party (CCP) military officials have repeatedly claimed in meetings with their U.S. peers that the Taiwan Strait does not qualify as international waters, raising concerns within the Biden administration.

The report quoted informed sources as saying that CCP officials have told the U.S. Government repeatedly and at multiple levels, that they do not agree with the recognition of the U.S. view of international law on the Taiwan Strait as international waters. Instead, the United States and key allies believe that much of the Taiwan Strait constitutes international waters and regularly send naval vessels through the waterway as part of freedom of navigation exercises.

The report noted that the legal status of the waters had not previously been a frequent topic of conversation during meetings between CCP and U.S. officials, despite frequent protests by the CCP against U.S. military operations in the Taiwan Strait.

Source noted that it is not clear whether this means the CCP will take more hostile measures against U.S. and allied naval vessels that enter the Taiwan Strait.
